Liquor License Information
The Clerk & Recorder's Office is the local agent of the State of Colorado for
the issuance of liquor licenses in Teller County. Licensing includes a
public comment process.
Liquor License Document Checklist
Listed below are the documents required by the State and County for all new
licenses and transfers of ownership. All documents must be properly signed and
must correspond exactly with the name of the applicant.
1. Application: The original application must be
filled out completely and all questions must be answered. The application shall
be filed with the office of the Clerk and Recorder. Each application shall be
verified by the oath or affirmation of such persons as prescribed by the State
licensing authority.
Applications for liquor license may be obtained by
contacting the Teller County Clerk & Recorder's
office.
2. Fee:
Depending on class of license, new applications range from $1700 to $2100.
Please refer to the Fee Schedule for County
and State fees. The fee for history check through CBI must be made with
certified funds.
3. Proof of Property Possession: If the applicant owns
the building or space where the business is located, a signed copy of the deed
must be attached. The deed must be in the name of the applicant only.
If the building or space is leased, a copy of the lease
(signed by all parties) must be attached. The term of the
lease is to be for at least on year. The lease must be in
the name of the applicant only. The physical address of the
location must be included. Post office boxes and legal
descriptions are not acceptable. These requirements also
apply to subleases and lease assignments.
4. Background Information: An
Individual History form and fingerprinting must be completed
by:
Individual - Each individual applicant
Partnership - Each general and each limited partner
who hold over 5% interest.
Public Corporation - Each officer, director, and
stockholder holding over 5% interest.
Private Corporation - Each officer, director, and
stockholder with any interest in the corporation.
The applicant will need to obtain a minimum of three letters
validating good character and reputation.
If the license is a transfer of ownership, a letter must be
submitted by the owner authorizing the purchase agreement.
5. Diagram: A diagram of the
premises, outlining in red, the areas where liquor will be
served and/or stored, must be attached. The diagram should
be no larger than 8 x 11 inches and each floor should be
drawn separately.
6. Corporate Documents: If
applicant is a corporation, the following documents must be
attached to the application:
Certificate
of Incorporation
Certificate
of Good Standing if the corporation is more than two years
old
Certificate
of Authorization if the corporation is foreign
Minutes of
the meeting showing the current elected officers
7. Partnership Documents: If the applicant is
a partnership, the following documents must be attached to the
application:
Partnership
agreement identifying all partners (this requirement is not necessary
for husband and wife partnerships)
Dissolution
of partnership (if applicable)
8. Management: A Manager’s Registration form, with
required fee, must be completed ONLY for a Hotel/Restaurant whose manager is
someone other than the applicant. For any other class of liquor license, the
applicant is only required to report in writing, the name of the manager to the
state and local liquor authorities and no fee is required. This may be done at
the time of initial application and/or any time there is a manager change.
9. Petition: Applicant shall furnish the Clerk and
Recorder’s Office with petitions from residents of the neighborhood indicating
their opinion as to the needs and desires of said neighborhood. Petitions must
be posted for both positive and negative opinions. The petitions must be filed
with the Clerk & Recorder’s office not less than ten days prior to the hearing.
10. Financing: Applicant shall submit to the Clerk and
Recorder’s Office information concerning financial and management associations
and interest of applicant and/or other persons in the business.
Procedure For New Liquor License Application
All applications for liquor license must be submitted on the original forms,
typewritten or legibly printed in black ink. The applicant should retain a
photocopy of the application. Application is not complete until all required
attachments and fees are submitted with the application to the Clerk and
Recorder’s Office.
Once the completed application is received, the application for license will
be added to the next open agenda for the Teller County Board of County
Commissioners’ meeting which is scheduled at least thirty days from the date of
filing. The hearing will be noticed in the County’s official newspaper not less
than ten days prior to the hearing date. Applicant is required to attend this
scheduled meeting and the date of the meeting.
Following approval by the Teller County Board of County Commissioners, the
application is forwarded by the County to the Colorado Department of Revenue,
Liquor Enforcement Division. After approval by the State, the state license is
sent to the Clerk and Recorder’s office and both State and County licenses are
issued to the applicant. Both licenses must be in possession of the applicant
before service of liquor is begun. The anticipated time from submission of the
application to receiving the licenses is approximately forty five days.
